General Housing Information
The functions granted by Law No. 65, the General Housing Law, to the National Housing Institute and its President, are assumed by the Ministry of Construction and its Minister.
It is important that when requesting a procedure before the organizational units of the Housing System, when notified, take into account what is contained in the administrative resolutions, as well as the veracity of the general ones provided.
Representation can be used for most of the procedures, which can be: Legal, when the parents or guardians represent people who do not have the capacity to act; or voluntary when having it, the owner decides to appoint a representative who can be a law firm attorney or a proxy by contract formalized before a notary. In any case, the legal representative must request the Order of Utility and Necessity before the Prosecutor's Office which is issued by the Court.
In the event that the homeowners have a certain debt for the payment of the property, it is necessary to prove the condition of being up to date with the payment or having settled the debt, by means of a document previously issued by the bank branch. This point is repeated for all procedures.
The procedures are requested through the representatives of the specialized areas that act in the procedures offices (in municipalities that do not have procedures offices, the specialist resides in the specialized area itself).
The pronouncements of the housing directorates have a legal claim before the corresponding Provincial People's Court and against what is resolved by it, an appeal is brought before the Supreme People's Court. The claim to the Provincial Court proceeds within 30 business days from of the notification date.
