Change of Labor Location in Social Service

The fulfillment of the social service is established in Law 116/2015, Labor Code and Decree 326 and the change of work location in resolution 8/2013 of the Ministry of labor and social security.

Social service consists of fulfilling the duty of graduates of daytime courses, who attain knowledge at the higher and professional technical level of education, to put them into society's function in accordance with the planning and priorities of economic and social development .

Social service lasts for three years and is combined with active military service, so that the sum of both completes the three years and is carried out in the place and work in the entity to which the graduate is assigned.

When it is necessary to transfer a graduate assigned to an organ, body, national entity, senior management organization or other entities for the fulfillment of the social service, to another, it is submitted to the approval of the authorities who assigned him, from the conformity of both organs, agencies, national entities or superior management organizations or other entities.

In cases of internal transfers, approval is submitted to the head of the organ, agency, national entity, senior management organization, or other entities or to whom he delegates, where the graduate was assigned.

Higher Education Graduates

Annex 2 of Resolution 8 of 2013 of the Ministry of Labor and Social Security establishes the procedure for processing changes in the job placement of recent graduates of middle and higher level technicians and it is necessary to specify the terms for said process :

  1. The process of change of work location is requested by the worker based on the written justification of his need to transfer to the entity where he was assigned with an acceptance letter from the requesting body.
  2. If the entity does not agree to grant the release, it notifies the worker within ten (10) business days.
  3. If the entity agrees to grant the release, it notifies its agency which, in turn, will be in charge of notifying the worker, the result of the analysis within a term of ten (10) business days.
  4. The agency evaluates the request and within a term of ten (10) business days notifies the worker of the response and issues the letter of release, to start the process at the Ministry of Labor and Social Security.
  5. The Ministry of Labor and Social Security has a term of ten (10) business days to approve or not, the transfer request.
  6. For movements of Higher Level graduates; The releasing body is responsible for submitting to the Ministry of Labor and Social Security the file consisting of:
  7. Letter of release with the authorized signature of the body to which the graduate was assigned, addressed to the National Director of Employment of the Ministry of Labor and Social Security.
  8. Letter of acceptance with the authorized signature of the body that accepts the graduate, addressed to the National Director of Employment of the Ministry of Labor and Social Security.
  9. Graduate Work Placement Report or its copy.

Graduates of Technician of the upper middle level

The letter of request for release, from the body, with the corresponding justification and the letter of acceptance from the body to which you are proposing to transfer the graduate, is presented to the Provincial Directorate of Labor.

In the case of graduates of Technician of Upper Middle Level who are assigned to the organisms of the Central State Administration or their entities of national subordination, only the release letter can be issued by the provincial Delegate of the organism, for those who have that structure, or the Director of the Company when not. In the case of graduates who are assigned to local subordinate entities (Provincial Administration Council), the director of the provincial company or of the provincial sector to which they subordinate may issue the letter of release. In all cases, they must be addressed to the Provincial Director of Labor, who is in charge of issuing the authorization for the change, if appropriate.

The release for the change of work location is only effective, from having in the entity with the written approval of the Provincial Director of Labor.

Are you interested in starting as a Self-Employed Worker?

The person interested in exercising the work on their own, submits the following documents to the designated official of the entities that issues the authorization, in order to decide whether the request is appropriate or not:

    a) Request brief;
    b) identity card;
    c) two 1x1 photos;
    d) request for authorization to employ contract workers and draft employment contract or equivalent document, where the agreed clauses and conditions are specified;
    e) authorization of the Historian or Conservator, as appropriate, in the cases in which he intends to carry out the activity within the limits of the Priority Conservation Zone; and
    f) other required documents, in correspondence with the activity to be carried out.

What is the content of the documents you must submit?

  • Description of the activity you intend to carry out and the place where you are going to carry it out;
  • Sworn declaration of the origin of the financing source and the investments made or to be carried out in the activities: Landlord of housing, rooms and spaces; Automotive equipment grease scrubber; Blacksmith; Bodybuilding gym instructor; Recreation equipment operator; Baker- confectioner; Producer selling footwear; Sheet metal service; Building construction, repair and maintenance services; Gastronomic service in cafeteria; Gastronomic service in restaurant; Bar and recreation service; Transportation of cargo and passengers with automotive, rail and maritime means;
  • Origin of the equipment and means, when appropriate;
  • Compliance with the rules of Physical Planning, hygiene, food safety, rational use of water, environment and fire protection, when appropriate;
  • Interest in using posters, artistic services or both;
  • Production or service schedule, in accordance with the provisions of the People's Power Administration Council; and
  • Source of origin of the interested party for the purposes of affiliation to social security.

When the request is to carry out activities in dwellings, rooms or spaces, in which acts constituting a crime have been committed on occasion of the exercise of self-employment, the empowered authority does not issue a new authorization.

Social care

The Social Security Law No. 105 of December 27, 2008 provides in its article 4 that the Social Assistance regime protects any person not fit to work who lacks obligated relatives in a position to provide help, and also Article 105 that that Social Assistance protects the elderly without resources or protection and others who require it, and protection is granted through monetary benefits, species and services as referred to in article 109 of said Law.

Procedure for granting the monetary benefits of social assistance:

Temporary monetary benefits are those granted when a family nucleus presents a situation of need.

Exceptional temporary monetary benefits are those that are granted to individuals or family nuclei, on a temporary basis, in amounts greater than those established in the scale and approved by the MTSS.

Services in Service:

  • Social Worker at Home: It is only granted to older adults or people with disabilities, who live alone, lacking family members obliged to provide help or cohabiting people, and who are bedridden or with restricted mobility.
  • Food service: It has an amount of $ 45.00 per month for each beneficiary.
  • Grandparents' house service: Payment for the service is made in one of the following ways as provided in section four of Resolution 46 of 2014:

Total for the elderly and their required relatives

Partial for social assistance, when the elderly and their required relatives in cases where they exist have insufficient income to assume full payment of the service

Total for social assistance in the event that the lack of income of the older adult is demonstrated and does not have obligated relatives in a position to provide assistance.

     4. In-kind benefits: In-kind benefits are the resources given to those nuclei with critical social situations.

Approval of a benefit or service of Social Assistance

The need for protection of Social Assistance is determined when the incapacity of the members of the family nucleus to enter employment, motivated by health situations, disability or other causes that justify it, is verified as insufficient income to assume food, medicines, payment of basic services and the lack of relatives forced to provide help.

To request Social Assistance protection, you must contact the Municipal Labor Directorates of the municipality of residence, showing the identity card to the official from the Department of Prevention, Assistance and Social Work who attends you.
